On February 16, 2006, the City of Gainesville Code Enforcement Board (“Board”) issued an Order in Code Enforcement Board case number CEB2006-077. The Board found violations of certain sections of the City of Gainesville Code of Ordinances at property owned by Mr. Tedford located at 412 N.W. 3rd Avenue, Gainesville, Florida, and assessed a fine of $250.00 per day for each and every day the violations continued. On April 18, 2008, the City of Gainesville filed suit against Mr. Tedford in the Circuit Court of Florida’s Eighth Judicial Circuit, in and for Alachua County, Florida, in case number 01-08-CA-001760, seeking to enforce the lien arising from Code Enforcement Board case number CEB2006-077, and to foreclose on the property located at 412 N.W. 3rd Avenue, Gainesville, Florida. On September 8, 2008, the Circuit Court of Florida’s Eighth Judicial Circuit, in and for Alachua County, Florida, in case number 01-08-CA-001760, issued a Summary Final Judgment of Foreclosure in favor the City of Gainesville in the amount of $97,181.32, and instructed the Clerk of the Circuit Court of Alachua County to sell the property located at 412 N.W. 3rd Avenue, Gainesville, Florida at public sale on Thursday, October 30, 2008.
On October 14, 2008, the City of Gainesville was served with a Summons and Amended Complaint for Declaratory Judgment filed by Mr. Tedford in case number 01-08-CA-5171 in the Circuit Court of Florida’s Eighth Judicial Circuit, in and for Alachua County, Florida.
