An ordinance of the City of Gainesville, Florida, to vacate, abandon, and close a certain public right-of-way generally located south of SW 4th Avenue, west of SW 12th Street, north of SW 5th Avenue, and east of SW 13th Street, as more specifically described in this ordinance, subject to terms and conditions; providing directions to the Clerk of the Commission; providing a severability clause; providing a repealing clause; and providing an effective date.

The City Commission adopt the proposed ordinance.

 

Explanation

STAFF REPORT

 

This ordinance vacates, with certain conditions, a portion of a 15-foot wide east/west alley and a 20-foot wide north/south alley that lays between SW 4th and 5th Avenues.  The east/west right-of-way distance is approximately 300 feet and the north/south right-of-way is approximately 150 feet.  The right-of-way to be vacated is improved and totals approximately 4,800 sq. ft. (+/- 0.12 acres).  Vacation of this public right-of-way will facilitate the redevelopment of the adjoining properties as part of a high-density, multiple-family development. All of the adjacent property owners, including the applicant, agree to this vacation of public right-of-way. The City Commission may vacate a public right-of-way upon its finding that the criteria in Section 30-3.41 of the Land Development Code have been met.
