Title

Fiber Swimming Pools Request for Accessory Outdoor Storage (B)

Petition AD-21-00189:  Stuart Cullen, agent for Fiber Swimming Pools., applicant, and Beaty Elizabeth Trustee, owners.  Requesting authorization to allow outdoor accessory storage and display up to 25% of the existing indoor storage area.  Zoned: BA (Business Automotive) Located at 4322 NW 13th. Street.

Explanation

The applicant operates an office associated with the sales and installation of in-ground fiberglass pools at the above location.  The office use is allowed by right in the BA zoning district.  Outdoor display of goods is permitted as an accessory to the office use contingent upon certain criteria being met and maintained. Code Enforcement has cited the applicant for storing and displaying swimming pool shells alongside the right-of-way in front of the subject property and in violation of the Land Development Code.  The code provides an opportunity for the Development Review Board (DRB) to consider a request to allow up to up to 25% of the existing indoor storage area to be used as outdoor accessory storage and display, subject to the criteria found in Section 30-5.41.

The applicant is requesting that the DRB consider a request to have limited outdoor accessory display and storage, consistent with the requirements of the Land Development Code.

Fiscal Note

None.

Recommendation

Review Petition Petition AD-21-00189, for compliance with the criteria for allowing accessory outdoor display and storage.
