Explanation
This is a request to grant Conditional Final Plat approval for Walnut Creek Phase II which has received Design Plat approval as Petition 156SUB-06PB. Those petitions represent the implementation of the Walnut Creek Planned Development, Petition 44PDV-00PB and its amendment, Petition 83PDA-06PB.
The Walnut Creek residential development was proposed in two phases with 138 lots on 30 acres. The first phase included 73 lots and was approved by the City Commission on May 22, 2003. Phase II was originally designed with 65 lots but has been reduced to 55 lots in order to accommodate a redesign of the stormwater management system After completion of Phase I, but prior to accepting the infrastructure, the city discovered that the stormwater management system did not function in accordance with City standards and created stormwater management concerns within the neighborhood. The proposed solution was to incorporate a design in Phase II that would address the stormwater management needs for both the existing improved Phase I as well as the needs for the proposed Phase II portion.
The City Commission approved the Design plat of Phase II on April 14, 2008 which included 55 lots. The applicant proceeded through Construction Drawing review and approval and submits this petition for Conditional Final Plat for Phase II. Conditional Final Plat is a variation of the final plat approval process that allows a developer to begin construction of a subdivision without the financial obligations of securing the construction cost of the infrastructure. City Public Works conducts inspections during construction to ensure that the improvements are constructed to City standards. After final construction of infrastructure, the developer may record the plat with the Property Appraiser's office and may commence the sale of lots to the general public. At such time, a bond is required to warranty the infrastructure for a one year period.

Planning Staff to City Commission - The City Commission adopt the following resolution: A Resolution approving the conditional final plat of "Walnut Creek Phase II A Planned Development", located in the vicinity of NW 26th Street and NW 31st Avenue, Gainesville, Florida; providing directions to the Clerk of the Commission; providing conditions and restrictions; and providing an immediate effective date.
