Title

Southwest 13th Street Moratorium Extension (B)

Explanation

The City Commission imposed a temporary moratorium within the Southwest 13th Street Corridor by adopting Ordinance No. 002084 on December 20, 2001.  The Ordinance imposed a moratorium for the 227-day period from December 20, 2001 through September 23, 2002 on zoning permits, site plan approval and any other official action of the City of Gainesville permitting or having the effect of permitting development or use on all real property zoned BUS (General business district), BT (Tourist-oriented business district) and any commercial use on all real property zoned MU-1 (10-30 units/acre mixed use low intensity), RMF-5 (12 units/acre single family/multiple-family residential district), RMF-6 (8-15 units/acre multiple-family residential district), RMF-7 (8-21 units/acre multiple-family residential district), RMF-8 (8-30 units/acre multiple-family residential district), OR (20 units/acre office residential district), RH-1 (8-43 units per acre residential high density district), and RH-2 (8-100 units/acre residential high density district) located with the Southwest 13th Street corridor.  This corridor is generally bounded on the North by Southwest Archer Road, and on the South by the City limits.

On December 20, 2001, the City Commission also approved staff's recommendation for a scope of services for the Southwest 13th Street Charrette, a joint planning project with Alachua County.  The charrette will lay the groundwork for a special area plan (overlay district) for the Southwest 13th Street corridor.  The charrette was originally tentatively scheduled for the 5-day period from March 9th through March 13th, but has been rescheduled to May 4th through May 8th.  This two-month delay in the charrette necessitates corresponding delay in the submission date for the final report from the consultant that will conduct the charrette, and in staff's subsequent preparation and presentations of a special area plan overlay for the Southwest 13th Street corridor.

Because of the above-described delays in the Southwest 13th Street planning process, staff recommends that the temporary moratorium for the Southwest 13th Street corridor be extended by 64 days, from 11:59 PM on September 23, 2002 through 11:59 PM on November 25, 2002.

Fiscal Note

None.

Recommendation

The City Commission hear a presentation from staff, approve staff's recommendation for extending the temporary moratorium by 64 days from September 23, 2002 through November 25, 2002, and authorize the City Attorney to draft the appropriate amendments to Ordinance No. 002084.
