An ordinance of the City of Gainesville, Florida; amending Appendix A of the Code of Ordinances; correcting scrivener's errors relating to user fees, rates and charges as more specifically set forth in the ordinance, and generally related to buildings and building regulations; cemeteries; land development code landlord permit fees; Police, alarm fees; and traffic and motor vehicles; increasing some fees, rates, and charges in Appendix A; providing directions to the codifier; providing a severability clause; providing a repealing clause; and providing an immediate effective date.

The City Commission adopt the proposed ordinance.
 
explanation
With approval of the City Manager's general government budget on July 24, 2003, the Commission requested that all fees be increased by 5%. Appendix A to the Code of Ordinances (Schedule of Fees, Rates and Charges) was amended accordingly and on August 25, 2003 the City Commission adopted Ordinance 030165, increasing certain user fees by 5%. The new fee amounts took effect on October 1, 2003.  
 
Subsequent to the adoption of Ordinance 030165, technical errors in the ordinance were discovered. Upon request of the City's management, the City Attorney prepared and the Clerk advertised the proposed ordinance to correct these errors at the earliest possible opportunity. The corrections contained in the proposed ordinance are as follows:
 
Section 1.  The Building Regulations valuation table, with charges based on square footage, was overlooked in the fee increase project; however, consistent with the City's budget goals, the Building Department has asked that these fees also be increased by 5%. The proposed amendment increases these fees by 5%.
 
Section 2.  Proposes a conforming cross-reference to the title of section 7-13 of the Code.
 
Section 3.  Landlord permit fees were increased by a separate ordinance earlier this year (ordinance 0-03-34, adopted April 14, 2003) and were not increased by the fee increase amendment; however, the text of the Code, as published in the August 25, 2003 Ordinance, did not reflect the new Landlord permit fee rates. Section 3 of the proposed amendment restores the language, as passed by the Commission by a 5-0 vote on April 14, 2003.
 
Section 4.  On May 8, 2000 the City Commission adopted the City of Gainesville False Alarm Ordinance thus including fees and fines for false alarms within the text of the Code of Ordinances (at Chapter 21) rather than in Appendix A to the Code of Ordinances (Schedule of Fees, Rates and Charges). The proposed amendment merely reserves this section for future use when amending and increasing these fees.
 
Section 5.  This is a conforming cross-reference to clarify statutory authority for this additional fee.
 
The proposed ordinance will require two public hearings.  Should the Commission adopt the ordinance on first reading, the second and final reading will be held on Monday, October 27, 2003.
