Explanation
In an effort to improve the aesthetics of the NW 8th Avenue corridor, GRU is in the process of removing the overhead electric facilities along the roadway between Main Street and NW 6th Street. Several businesses located along the north side of 8th Avenue are served via this overhead primary electric line. In order to insure uninterrupted service to these customers, it will be necessary to re-feed these customers from other sources in the area.
At 504 NW 8th Avenue, there is an existing overhead secondary electric line being fed from the primary electric line along 8th Avenue planned for removal. This secondary line is covered by a twelve foot wide easement secured in 2001. To insure continued service to customers in this area, it will be necessary to re-feed this line from an alternate source. GRU staff has negotiated with the property owner to release two feet of the twelve foot easement in exchange for an additional easement on the property. The additional easement will facilitate feeding the line from another source of electricity located along NW 9th Avenue, north of the property. Releasing two feet of the existing easement will accommodate the property owner's desire to gain additional square footage for development on the property
Staff has evaluated this request and has determined that due to the location of the existing secondary electric line within the easement, releasing two feet of the easement would not hinder staff's abilities to operate and maintain the line safely. Therefore, staff has no objection to the partial release of this easement in exchange for the additional easement, which has been fully executed by the owner and accepted by staff.
Recommendations
The City Commission: 1) approve the partial release of an easement at 504 NW 8th Avenue; and 2) authorize the Mayor to execute the Partial Release of Easement document subject to approval by the City Attorney as to form and legality.
