An ordinance of the City of Gainesville, Florida, amending the Land Development Code, relating to requirements for residential high density districts; amending section 30-55, establishing a 5-story height limit for the RH-1 (8-43 units/acre residential high density district) and RH-2 (8-100 units/acre residential high density district) and removing floor area ratios; making certain other minor modifications for clarification; providing that the height limitations established in this ordinance do not apply to developments receiving approval on or before the effective date of this ordinance if approval has not otherwise lapsed or become void; providing directions to the codifier; providing a severability clause; providing a repealing clause; and providing an immediate effective date.

COMMUNITY DEVELOPMENT DEPARTMENT STAFF REPORT
The proposed amendments to the RH-1 and RH-2 zoning districts are a compilation of staff changes. The most significant changes include establishing a new 5-story height limit (currently, there is no height limit in these districts) and, partly as a consequence, removing the floor area ratio (FAR) limit.
The Plan Board heard the petition and recommended that it be approved.
Public notice was published in the Gainesville Sun on February 3, 2004. The Plan Board held a public hearing February 26, 2004, which was a continuation of the recessed meeting of February 19, 2004. Planning Division staff recommended that the Plan Board approve the petition. The Plan Board recommended that the City Commission approve Petition 27TCH-04 PB. Plan Board vote 5-0.
CITY ATTORNEY MEMORANDUM
This ordinance requires two public hearings. Should the Commission adopt the ordinance on first reading; the second and final reading will be held on Monday, June 14, 2004.
