An ordinance of the City of Gainesville, Florida, amending Appendix A of the Land Development Code, relating to the University Heights Special Area Plan; adding a required compliance section; deleting the idealized buildout map; adding a waiver from compliance section; deleting special use permit section; reducing the alley protection and width allowed; adding a 10-foot minimum height for the first story; adding new privacy obligations for building below grade; adding additional right-of-way protection; expanding the range of building materials allowed; strengthening and clarifying the sign regulations; adding provisions relating to mechanical equipment; deleting certain definitions; making minor changes to the Plan for clarification; providing directions to the codifier; providing a severability clause; providing a repealing clause; and providing an immediate effective date.

COMMUNITY DEVELOPMENT DEPARTMENT STAFF REPORT
The proposed amendments to the University Heights Special Area Plan are a compilation of staff changes and modifications recommended by the Chamber Code Review Committee. The most significant changes include: adding a new "required compliance" section; removing the idealized build-out map; adding new "waiver from compliance" language; deleting the "special use permit" provision; deleting several definitions which are included in the citywide definitions (Sec. 30-23); reducing alley protection and width allowed; adding a 10-foot minimum height for the first story; adding new privacy obligations for buildings below grade; adding additional ROW protection; expanding the range of building materials allowed; strengthening and clarifying the sign regulations; and adding provisions to make mechanical equipment more discreet.
The Plan Board heard the petition and recommended that it be approved with staff changes and modifications recommended by the City Plan Board.
Public notice was published in the Gainesville Sun on February 2, 2004. The Plan Board held a public hearing February 19, 2004. Planning Division staff recommended that the Plan Board approve the petition. The Plan Board recommended that the City Commission approve Petition 172TCH-03 PB, with recommended Plan Board modifications. Plan Board vote 4-1.
CITY ATTORNEY MEMORANDUM
The ordinance includes the revision made by the Commission at first reading in Exhibit A to the Ordinance, on page 3, paragraph B, "Waiver from Compliance," #4, adding the words "City Manager" and "designee".
