explanation
COMMUNITY DEVELOPMENT STAFF REPORT
 
This is a request to vacate a portion of Southwest 1st Street and Southwest 1st Avenue.  During the design of the parking garage, the architects and engineers, hired by the City of Gainesville, discovered that the parcel chosen for the garage had several site constraints.  One of those constraints is the overall size, approximately 200'x 200'.  Due to the combination of the retail/office space on the ground level, the City Code required sidewalk widths and having to design a structure that would maximize the number of parking spaces, a very complex building design resulted and the new parking garage encroaches slightly into the right-of-way of Southwest 1st Street and Southwest 1st Avenue.
 
The City shall retain utility and drainage easements over, under, across, and through the vacated right-of-way as needed.  The exact location of any new easements shall be determined at the time of final site plan approval of the garage.
 
The Plan Board reviewed the petition and approved the partial street vacations with the following revisions to the right-of-way widths initially requested to be vacated: The westerly 6 feet (not 10 feet) of Southwest 1st Street from Southwest 1st Avenue to Southwest 2nd Avenue and southerly 7 feet (not 5 feet) of Southwest 1st Avenue from Southwest 1st Street to Southwest 2nd Street.
 
Public notice was published in the Gainesville Sun on July 2, 2002.  Letters were mailed to surrounding property owners on July 3, 2002.  The Plan Board held a public hearing July 18, 2002.  Planning Division staff recommended that the Plan Board approve the petition, with conditions.  The Plan Board recommended that the City Commission approve Petition 57SVA-02 PB.  Plan Board vote 4-0.
 
CITY ATTORNEY MEMORANDUM
 
The petition and ordinance are simultaneously submitted to the City Commission for approval and adoption because city staff and the plan board both recommend approval.
