An ordinance of the City of Gainesville, Florida, amending the Land Development Code, relating to requirements for multiple-family medium density residential zoning districts; amending section 30-53, eliminating floor area ratio requirements, establishing a 3-story height limit by right, and a 5-story height limit by special use permit for the RMF-6 (8-15 units/acre); RMF-7 (8-21 units/acre) and RMF-8 (8-30 units/acre) multiple-family medium density residential zoning districts; making certain other minor modifications for clarification; providing directions to the codifier; providing a severability clause; providing a repealing clause; and providing an immediate effective date.

COMMUNITY DEVELOPMENT DEPARTMENT STAFF REPORT
This petition provides an opportunity to incorporate the new height restrictions approved by the City Commission for certain zoning districts.
The most important revision recommended is that the RMF-6, 7, 8 districts should have a 3-story height limit, and a 5-story height limit by special use permit. Currently, there is no limit for multi-family buildings in these districts. On January 26, 2004, the City Commission voted to support this height limit for these RMF districts, and directed the City Plan Board to initiate a petition to consider such a regulation. Related to this, another important recommended revision for the RMF-6, 7, and 8 districts is to eliminate the floor area ratio limits, since intensity would be controlled by a height limit.
The Plan Board heard the petition and recommended that, at a future time, staff and the board review a provision for stoops to be added as a criterion for permitting additional stories.
Public notice was published in the Gainesville Sun on May 31, 2004. The Plan Board held a public hearing June 17, 2004. Planning Division staff recommended that the Plan Board approve the petition. The Plan Board recommended that the City Commission approve Petition 55TCH-04 PB. Plan Board vote 6-0.
CITY ATTORNEY MEMORANDUM
This ordinance requires two public hearings. Should the Commission adopt the ordinance on first reading; the second and final reading will be held on Monday, September 27, 2004.
