Explanation
This is a request for conditional final plat approval of Phase 1 of the Madera Cluster Development, consisting of 26 lots on 12.223 acres. The land was annexed by the City of Gainesville in April of 2000, and still retains the County R1-a zoning designation.  This petition has been reviewed under Alachua County regulations affecting cluster subdivisions, R1-a zoning, and the Idylwild/Serenola Special Area. The Idylwild/Serenola Special Area is regulated by County-adopted land development regulations that are intended to ensure environmental issues are adequately addressed during the development review process.
 
On October 22, 2001, the City Commission approved the design plat of Madera Cluster Development, for eighty-eight (88) lots on 44.59 acres, more or less.  Phase one of the development has a density of 2.13 units per acre.  However the overall density of the development will be 1.97 units per acre, consistent with the two units per acre land use density limitation.  The City Commission approved the design plat subject to the staff conditions and the following additional conditions:  (1) A barrier of at least six (6) feet in height shall be placed on the west property line; (2) The barrier shall be provided prior to commencement of construction; (3) No construction shall occur on the western boundary of the property from November through March 15 of the first year of construction; (4) The petitioner shall provide staff with information on setbacks and dimensional requirements for proposed kiosks; (5) The sinkhole on the property shall be labeled as such; and (6) The petitioner shall treat the west property line as designated by the Florida Fish and Wildlife Conservation Commission.  This November through March 15 time frame has now passed, so the petitioner will propose for consideration at final plat a screening buffer instead.
 
The City Commission also included in the motion to approve the design plat, that the recommendation provided by the petitioner would include, substantially in the form provided on Page 2, striking the language "at its sole discretion" and adding the language at the end of the sentence "in concurrence with the Florida Fish and Wildlife Conservation Commission or something as mutually acceptable", that a hammerhead turn-around would be included at the final design plat, and the Madera Cluster Subdivision Construction Practices and Open Space Management Provisions shall be substantially included in the final design plat.  The hammerhead will be included at a later phase.
 
This request for conditional final plat approval is being made in accordance with Sections 30-186(e)(1)(2) and (3) of the City of Gainesville Land Development Code.  These provisions allow for a subdivision to be approved but not officially recorded until full completion of subdivision improvements in accordance with approved construction plans and specifications and City ordinances.  Upon certification by the City Manager that the improvements have been properly constructed and that there are no liens on the property and said improvements, the Clerk of the Commission will sign the prior approved plat and it may then be officially recorded.  Building permits shall not be issued until such time as the plat has been placed on the public records of Alachua County, Florida.

Planning Staff to City Commission - The City Commission adopt the following resolution:  A Resolution approving the conditional final plat of "Madera Cluster Development, Phase 1" located in the vicinity of Williston Road (north side), between Southwest 21st Street and Southwest 23rd Terrace; and providing an immediate effective date.
