COMMUNITY DEVELOPMENT DEPARTMENT STAFF REPORT
This petition is part of the on-going update of the land development code.  The proposed changes to the Corporate Park (CP) zoning district will further implement the Mixed-Use Medium-Intensity (12-30 units per acre) Future Land Use Category of the 2000-2010 Gainesville Comprehensive Plan.  The 2000-2010 Comprehensive Plan established a 5-story height limit, eliminated floor area ratio requirements, and changed the residential density range of the Mixed-Use Medium-Intensity category from 10-30 units per acre to 12-30 units per acre.  Proposed changes to the CP zoning district are to: establish a 5-story height limit for buildings, eliminate floor area ratio requirements, delete residential density and intensity requirements based on FAR (floor area ratio) change the residential density range to 12-30 units per acre, add Industry No. 8999 (Services, Not Elsewhere Classified), and add Outdoor cafes as an accessory use to Eating places.  
 
Outdoor cafes are presently allowed in the CP district, but they need to be specifically listed as accessory to Eating places, which are allowed by special use permit.  Industry No. 8999 (Services, Not Elsewhere Classified) provides for actuaries and various other uses appropriate as allowable uses in the CP district, particularly considering the requirement that any of these uses must be within enclosed buildings.  
 
The Special Area Plan for Triangle has been revised to keep it consistent with the underlying Corporate Park zoning.  The 4-story building height limit has been changed to a 5-story limit, and the previous provision for additional stories by special use permit has been eliminated.  
 
Public notice was published in the Gainesville Sun on March 31, 2004.  Letters were mailed to owners of property in the Corporate Park District on March 31, 2004.  The Plan Board held a public hearing April 15, 2004.  Planning Division staff recommended that the Plan Board approve the petition.  The Plan Board recommended that the City Commission approve Petition 28TCH-04 PB.  Plan Board vote 7-0.
 
CITY ATTORNEY MEMORANDUM
This ordinance requires two public hearings.  Should the Commission adopt the ordinance on first reading; the second and final reading will be held on Monday, August 23, 2004.
