Staff recommends approval of the final ranking of the construction management firms for the Sweetwater Branch/Paynes Prairie Sheetflow Restoration Project.
Explanation
The City Commission approved a contract for architectural and engineering services for the final design of the Project on February 18, 2010. Authorization was granted to meet regulatory obligations to improve water quality associated with the Florida Department of Environmental Protection Department permits for the Main Street Water Reclamation Facility and the Municipal Separate Storm Sewer System. Preliminary plans for the public use facilities were presented to the City Commission on June 17, 2010 in accordance with the City's Vertical Capital Projects procedure. Staff is engaged with the engineer in developing construction plans for the site improvements. The City Commission approved the construction of the water quality improvements and Phase I of the public use facilities in the FY11 Water/Wastewater and Stormwater Utility budgets. Phase I public use facilities will be dependent upon available grant funding and may include a parking area, entry building, hiking trails and boardwalks.
 
Staff has evaluated the various methods of project delivery for the Project, and is recommending use of a Construction Manager at Risk with Guaranteed Maximum Price (CMR with GMP). This method centralizes responsibility for the construction under a single contract and requires a bonded guaranteed maximum price for construction prior to the beginning of construction. Services to be provided by the CMR with GMP will be divided into two phases. The first phase of the project is referred to as Pre-construction Services supporting Design Services and will include such activities as cost analysis, construction and cost consulting, constructability review, scheduling, and ultimately the development of a guaranteed maximum price for the construction of the Project. Pre-construction Services will be paid at cost plus a negotiated percentage. Phase Two encompasses Construction Services and will include permitting, materials and trade procurement, and the general management of the construction of the Project. Phase Two Services will be paid as a GMP.
 
Utilities Purchasing issued a Request for Statement of Qualifications (RFSQ) for CMR services to the companies known to the State of Florida Department of Environmental Protection and St. Johns River Water Management District that perform this type of work. Three firms submitted Statements of Qualifications, which were ranked after evaluation in accordance with the criteria established in the RFSQ and CCNA.
 
The three firms made oral presentations to staff about their proposal. The final ranking is provided in the order of ranking and a tabulation of the evaluation is attached for your reference:

In accordance with the CCNA, staff is recommending initiating contract negotiations with the top ranked firm. If staff is unable to negotiate an acceptable contract with the top ranked firm, it may initiate negotiations with the other companies in order of ranking.
Recommendation
The City Commission:  1) approve the final ranking of the qualified construction management firms in the given order of preference for Construction Manager at Risk (CMR) services for the Sweetwater Branch/Paynes Prairie Sheetflow Restoration Project (Project); 2) authorize the General Manager, or his designee, to initiate contract negotiations with the top ranked CMR in accordance with the Consultants' Competitive Negotiations Act (CCNA); and, if not successful, to negotiate with the other ranked CMR's in order of ranking; 3) authorize the General Manager or his designee, upon successful negotiations, to execute a contract subject to approval of the City Attorney as to form and legality, in an amount not to exceed budgeted amounts for the project; and 4) authorize the General Manager or his designee to procure other services, equipment and materials, as required, to complete the project as budgeted.
Fiscal Note
Funding for this request is included in the Water/Wastewater Capital Improvements budget, the Public Works Stormwater Capital Improvements budget, from grant funding and outside funding partners.
