This is a request to declare as surplus and dispose of a portion of City Owned Property, Tax Parcel 13862-000-000, located at 1128 Northwest 7th Avenue.
Explanation
Tax Parcel 13862-000-000, located at 1128 Northwest 7th Avenue, is described as, Lot 16, Block 4, as per the plat of the W. R. Thomas Subdivision, Plat Book "A", page 27, of Lot 9 Browns Addition to Gainesville, Plat Book "A", page 6. The City acquired the vacant property, by Order of Taking and Final Judgment on November 19th, 1979 (Official Records Book 1247, Page 499). The parcel measured 39 feet, east and west by 100 feet, north and south. The approximately westerly 8 feet was used for the expansion of Northwest 12th Street, leaving the property 31 feet by 110 feet.
In and of itself, this property is not conducive to development. The adjacent property owner has requested to acquire the property. Current guidelines allow the sale of surplus property to the adjacent property owner, if that property has a value of less than $25,000. The tax assessed value for the whole property is $7,800 or $2 per square foot. Public Works is requesting the retainage of the southerly 10 feet and an additional 11 feet on the westerly side for public right-of-way. The portion to be declared surplus and sold will be 20 feet by 90 feet. The adjacent property owner has offered $3,600 for the parcel. Staff believes that it would be in the City's best interest to declare this property as surplus and return this property to the tax rolls by selling the property to the adjacent property owner.
Fiscal Note
Funding in the amount of $200 for administrative costs is available in the Public Works FY 2010 operating budget. Expenses incurred will be paid from Public Works operating funds and will be reimbursed from the sale proceeds, with the remainder deposited into the General Fund.
Recommendation
Recommended Motion: The City Commission: 1) declare the easterly 20 feet of the northerly 90 feet of Lot 16, Block 4, as per the plat of the W. R. Thomas Subdivision, Plat Book "A", page 27, Tax Parcel 13862-000-000, located at 1128 Northwest 7th Avenue as surplus; 2) authorize the City Manager to execute Purchase and Sale Agreement for that portion of Tax Parcel 13862-000-000, located at 1128 Northwest 7th Avenue to the adjacent property owner; 3) authorize the Mayor to execute, and the Clerk to attest, the Special Warranty Deed to convey , the easterly 20 feet of the northerly 90 feet of Lot 16, Block 4, as per the plat of the W. R. Thomas Subdivision, Plat Book "A", page 27 to the adjacent property owner; and 4) authorize the City Manager to execute all other necessary closing documents, subject to approval by the City Attorney as to form and legality.
Alternative Recommendation: The City Commission deny the request for surplus and sale of the property to the adjacent property owner and keep the property off the tax rolls.
