An ordinance amending the City of Gainesville 2000-2010 Comprehensive Plan, Future Land Use Map; by changing the land use category of certain property, located in the vicinity of 1019 Northwest 7th Avenue, as more specifically described in this ordinance, from the City of Gainesville land use category of "Residential Low Density (RL)" to the City of Gainesville land use category of "Public Facilities (PF)"; providing a severability clause; providing a repealing clause; and providing an effective date.

PLANNING AND DEVELOPMENT SERVICES DEPARTMENT STAFF REPORT
This petition and ordinance is a small-scale land use amendment to change the Future Land Use category from Residential Low-Density (RL) to Public Facilities (PF) for a .27 acre parcel in the Fifth Avenue neighborhood in northwest Gainesville. The property was the family home of local educator A. Quinn Jones for over 70 years. Upon his death, the property was donated to the City. The home has been placed on the National Historic Register. The Gainesville Community Redevelopment Agency plans to develop the home into a museum, necessitating a change in the land use category.
After public notice was published in the Gainesville Sun on April 12, 2011, the City Plan Board held a public hearing on April 28, 2011, and by a vote of 4-0, recommended approval of this petition.
A related petition (PB-10-121 PSZ) and ordinance, on this agenda, propose to change the zoning on the property from the City of Gainesville zoning district of "Residential Low Density district-Residential Conservation-12 units per acre (RC)" to the zoning district of "Public Services and operations district (PS)".
CITY ATTORNEY MEMORANDUM
The proposed amendment to the Comprehensive Plan is treated as a small scale development activity. After the City Commission adopts the ordinance, any affected person may file a petition with the State Division of Administrative Hearings to request a hearing to challenge the compliance of a small scale development amendment within 30 days following the City's adoption of the amendment.
Small scale development amendments do not become effective until 31 days after adoption. If challenged within 30 days after adoption, small scale development amendments shall not become effective until the state land planning agency or the Administration Commission issues a final order determining that the adopted small scale development amendment is in compliance.
