Resolution and Perpetual Easement associated with the Gainesville Police Department and the Board of Trustee of the Internal Improvement Trust Fund (BTIITF) (B)  
 
This item involves the adoption of a Resolution for the request of Utility easements in exchange for the granting of an easement associated with the development of the Gainesville Police Department campus.
 
Explanation
As part of the development of the Gainesville Police Department (GPD) campus, it is necessary to apply to the Board of Trustee of the Internal Improvement Trust Fund for easements over portions the 6th Street Rail Trail, Tax Parcel 14444-100-000, associated with parking, sidewalks, and utilities.  Three utility easement crossings are needed; one each for storm sewer, wastewater and electric/communication services.  One additional easement is needed for utilities and sidewalk/parking.  In exchange for the grant of these easements over portions of State owned property, the City will convey onto the State a Public Ingress/Egress easement for the re-routing of the 6th Street Rail Trail to the eastern boundary of the GPD campus.  This easement area will be for the improvements of the pedestrian trail and will be granted to the State in perpetuity.
 
Fiscal Note
Funding in the amount of $200 for administrative costs is available in the Public Works Fiscal Year 2013 operating budget.
 
Recommendation
The City Commission; 1) authorize the City Manager, or designee, to apply for Perpetual Easements from the Board of Trustees of the Internal Improvement Trust Fund (BTIITF) over portions of Tax Parcel 14444-100-000 and execute any required application documents , 2) adopt a Resolution requesting four Perpetual Easements from  the BTIITF to the City, in exchange for the granting of one easement from the City to the BTIITF, subject to approval by the City Attorney as to form and legality, and 3) If the request is approved by the BTIITF, authorize the Mayor to execute the easement to the BTIITF, subject to approval by the City Attorney as to form and legality.
