explanation
COMMUNITY DEVELOPMENT STAFF REPORT
 
The petitioner is proposing to close approximately a 10 wide by 179-foot long section of the south side of the ROW of Southwest 5th Avenue.  The closing is requested in order for the stoops, with steps on new rowhouses that have been approved for the adjacent lot to be built within the private property, although there is a provision in the University Heights Special Area Plan.  The ROW is 70 feet wide in this section.  The proposed street vacation will not affect the width of the paved street, nor will it include the public sidewalk.
 
Public notice was published in the Gainesville Sun on July 1, 2003.  Letters were mailed to surrounding property owners on July 2, 2003.  The Plan Board held a public hearing July 17, 2003.  Planning Division staff recommended that the Plan Board approve the petition.  The Plan Board recommended that the City Commission approve Petition 74SVA-03 PB.  Plan Board vote 5-0.
 
CITY ATTORNEY MEMORANDUM
 
The petition and ordinance are simultaneously submitted to the City Commission for approval and adoption because city staff and the plan board both recommend approval.
