Resolution Accepting Deed from FDOT for Conveyance of Land Located in the 3400 Block of East University Avenue for Fred Cone Park (B)
 
Explanation
The City is developing a sports and recreational area, known as Fred Cone (formerly Young American) Park, to the east of and south of State Road 26, located in the 3400 block of East University Avenue.  While in the process of site clearing, a monument was discovered denoting a 25-foot by 623.95-foot easement area that had not been detected during the survey process.  Upon further investigation it was determined that the Florida Department of Transportation (FDOT) owns this area as a right-of-way for State Road 26.  The proposed driveway entrance to Fred Cone Park crosses this land owned by FDOT.  
 
FDOT has agreed to release the property, which runs along the park area to Southeast 34th Street, to the City for use as a park.  The City needs a portion of this property for the driveway entrance and will designate the remainder as a conservation area.  FDOT is preparing a deed to convey that land to the City for its use, with a reverter clause stating that if FDOT needs the property for transportation related purposes in the future, the property will revert back to FDOT.  In order for FDOT to prepare a deed of conveyance in favor of the City, the City must draft and approve a resolution requesting that the FDOT convey the land to the City for use as a park, and stating that the City will accept the land, so offered.

Recommendation
The City Commission adopt the Resolution requesting the Florida Department of Transportation convey property to the City by deed, accepting the right-of-way so conveyed, and providing that the right-of-way so conveyed will be used for the public interest and welfare.
