Perpetual Transportation Easement to Alachua County (NB)
Explanation
The Alachua County Public Works Department has designed a new westbound right turn lane along NW 53rd Avenue to alleviate traffic congestion for those vehicles trying to enter NW 34th Street from NW 53rd Avenue. The proposed design will also increase the size of the pedestrian island to improve the safety for individuals on foot or on bicycles.

The proposed location of the new turn lane and pedestrian island will cross through the City of Gainesville transmission right-of-way between the electric transmission poles. The construction plans for these intersection improvements have been reviewed and approved by the Energy Delivery and Water/Wastewater Engineering departments. At the request of the Energy Delivery Department, Alachua County has agreed to install a guardrail along the west side of the turn lane to safeguard the electric transmission pole located closest to the turn lane. The County has also agreed to provide landscape buffering around the transmission pole for aesthetic purposes. The landscaping will not conflict with any existing visual traffic ordinances.

For this project to proceed, the City will need to grant a Perpetual Transportation Easement to Alachua County for this project. The City would retain fee simple title to the transmission right-of-way. An Indemnification clause has been incorporated into the easement document and a separate indemnification agreement will be executed by the Chairman of the Board of County Commissioners of Alachua County protecting and defending the City of Gainesville from all claims or expenses arising from or relating to the County's utilization of the easement area for transportation purposes.
Recommendations
The City Commission hear a presentation from staff and take those actions the Commission deems appropriate.
