Explanation
September 4, 1968 a thirty-foot easement for the construction, operation and maintenance of an above ground power transmission line was granted to the City of Gainesville at 3417 SW Archer Road. Recently a survey of the property has revealed that a building encroaches into this easement.
In order to convert overhead utilities to underground along SW Archer Road a new easement running along the east line of this property is required. Staff has successfully negotiated with the property owner to release the existing thirty-foot easement in exchange for a new easement to facilitiate our undergrounding project.
It has been confirmed that no electric, water, sewer or gas facilities exist within the easement to be released, therefore staff has no objection to the release. It should also be noted that it is staff's intent to hold the release of easement document until such time as a fully executed replacement easement is received. Upon the receipt of the new easement both documents will be recorded simultaneously in the Public Records.
Recommendations
The City Commission: 1) approve the release of a public utilities easement to D. W. McBride; and 2) authorize the Mayor and Clerk of the Commission to execute the Release of Easement, subject to approval as to form and legality by the City Attorney.
