An Ordinance of the City of Gainesville, Florida; amending subsection 14(a), Chapter 9, City of Gainesville Code of Ordinances, relating to a member of the City Board of Canvassers; providing that an active participant in the campaign or candidacy of any candidate who has opposition in the election being canvassed shall not serve on the Board of Canvassers; providing directions to the codifier; providing a severability clause; providing a repealing clause; and providing an effective date.

explanation
On November 10, 2003 the City Commission authorized the City Attorney to draft and the Clerk of the Commission to advertise an ordinance to amend the City Code provision on the composition of the City Canvassing Board to expressly exclude as a member a commissioner who is an active participant in the campaign or the candidacy of any candidate who has opposition in the election being canvassed. This amendment is recommended to avoid the appearance of impropriety in the canvassing of votes in city elections, and is consistent with the state election code.
This ordinance requires two readings. Should this ordinance pass on first reading, the second and final reading will occur on December 8, 2003.
