Explanation
In response to citizens comments at the October 8, 2001 Commission meeting, the City Commission requested that staff prepare a report on the steps necessary to amend the City Code to allow more overnight residents at the St. Francis House. In order for the City to allow more overnight residents at the St. Francis House, the City Commission would have to amend the Land Development Code. Section 30-110(d) regulates the number of beds. This Code section states "the total number of beds that may be provided in any residence for destitute people in a twenty-four-hour period is thirty (30)." If this section were amended by the City Commission, and the St. Francis House chose to increase the number of beds, the facility would then need to apply to the Plan Board for an amendment to the Special Use Permit.

The process for amending the City Code and granting a special use permit limit would be as follows:

1. City Commission directs staff to change the code to allow a certain
number of beds.

2. Staff prepares a staff report to the Plan Board.

3. Plan Board holds a public hearing and forwards recommendation to the
City Commission.

4. City Commission holds a public hearing and directs the City Attorney to
prepare an ordinance if the Commission wants to make a change. (The
City Commission will probably want to have a public hearing regardless of
whether the Plan Board approves the petition due to the level of public
interest).

5. City Commission Ordinance (1st Reading).

6. St. Francis House applies to amend their Special Use Permit for the
number of beds.

7. City Commission Ordinance (2nd Reading).
