Explanation
The City Commission requested staff review a request from Terrell Beard for an exception to the Mobile Vendor Permit. However, current City ordinance does not cover mobile food vendors on private property. Staff recommendations are based on previously established practices from Marion County where Mr. Beard is currently licensed.

Mr. Beard has a special made cooking trailer for preparing the meat. His mobile self-contained 12-foot cooking unit is wood burning/double insulated and the ovens were especially designed due to his physical capabilities. Mr. Beard also has a 20-foot trailer to service food. He already has the approval of the Department of Business and Professional Regulation, Division of Hotels and Restaurants for the use of this cooking and food service unit. The service trailer and cooking trailer will be brought in and out each day of operation. The hours of operation are Thursday 11 am - 7 pm, Friday and Saturday 11 am - 11 pm.

The occupational license and peddlers permit will be registered with the City and renewed each year. A current lease with the property owner will be required on the site he is using at 320 SW 16th Avenue.

Staff believes the parking lot food vendor approval should go through a staff review process which will allow for parking lot vendors to sell fruit, vegetables, produce, peanuts (boiled or roasted), hot dogs or sausages and barbecued meat. Sales of hot dogs, sausages and barbecued meat shall be from a Florida Department of Business Regulation, Division of Hotels and Restaurants approved cart.

Sale of the above listed merchandise shall be conducted from a flame retardant tent or approved mobile food cart. This facility shall be located on private property which is owned or leased by the vendor. Sales will be prohibited within the City right-of-way.
