Explanation

The subject property is located within an established single-family residential subdivision called Westvilla.  The subdivision lies north of NW 16th Boulevard on NW 37th Boulevard which transitions into NW 20th Place.  The subject property and surrounding parcels are zoned RSF-1, Single-Family residential.  The property is approximately 12,632 square feet in size and it includes a single-family dwelling with 1,512 square foot of heated space.  The parcel also contains an accessory storage structure, a concrete slab, a deck, a partially constructed pavilion, and walkways, all in the backyard.  The rear yard setback for a principal structure is 20 feet, but it is only 7.5 feet for an accessory structure.  The applicant is proposing to construct a pavilion with an adjacent deck in the rear yard of the single-family dwelling, placed at a setback of 3 feet from the rear property line; there would be 2 feet of distance from the rear yard fence which is a foot away from the property line.  According to the applicant, the concrete slab measures 12 feet by 12 feet and was installed by the previous owner, along with the concrete walkways that are present in the rear yard.  The slab was placed within 3 feet of the property line.  The applicant wants to place the deck and pavilion onto the existing slab because they feel it is the most feasible location for the pavilion.  The concrete walkways lie to the south of the slab between the slab and the house.  Some additional space in the yard lies under a 220v electrical feeder power line which would create an unreasonable danger since GRU does not allow structures to be placed under utility lines.  The proposed deck and part of the pavilion have already been constructed.
