On April 29, 2009 the City of Gainesville received a Request for Relief under Section 70.51, Florida Statutes, the Florida Land Use and Environmental Dispute Resolution Act. Under this Act, Christian Prison Ministries requests the appointment of a special magistrate to conduct a hearing on the land use restrictions in regard to the Ministries' property in the Five Points Special Area.
The special magistrate conducts a hearing to determine "whether the action by the governmental entity
is unreasonable or unfairly burdens the property". Within 14 days after the hearing, the special magistrate issues a written recommendation which must be accepted, modified, or rejected by the City Commission.
