Partial Release of a Public Utilities Easement to Stoneridge 3900 Corp. (NB)
Explanation
A 15' wide public utilities easement was granted to the City of Gainesville in 1976 for the installation, operation and maintenance of overhead electric facilities. Subsequent to that time, Stoneridge 3900 Corp. purchased the property and is in the process of developing Stoneridge Apartments Phase III.
During the initial phases of construction GRU staff discovered that the apartment building foundation encroached into the 15' wide easement. After consulting with the owners, it was agreed that the overhead electric facilities would be relocated to facilitate their development.
The owner has granted a replacement easement for the relocated facilities as well as other easements necessary to cover the installation and operation of additional utilities needed for the development.
This request has been reviewed and approved by the staff of GRU.
Recommendations
The City Commission: 1) approve the partial release of a public utilities easement to Stoneridge 3900 Corp.; and 2) authorize the Mayor-Commissioner and Clerk of the Commission to execute the Partial Release of Easement document, subject to approval by the City Attorney.
