This item is a request for approval and authorization to grant a Utility Easement to the Gainesville Community Redevelopment Agency.
Explanation
In 1976 the City of Gainesville acquired tax parcel 13807-000-000, located at 804 Northwest 5th Avenue, by eminent domain. Since its acquisition, the parcel has been used as parking for the community. In 2008 the Gainesville Community Redevelopment Agency (CRA) acquired the parcel adjacent and to the east of the city's parcel. The CRA parcel is being design for their future office with retail space. Due to the minimal size of CRA's parcel, a portion of the privately maintained domestic water facilities were designed to be located on the City's parcel. This will necessitate the City to grant a private utility easement to CRA.
The easement area requested is the Northerly Six (6.0) feet of the Southerly Thirteen and 1/3 (13.3) feet of the Easterly Seventeen (17.0) feet of Tax Parcel 13807-000-000, located at 804 Northwest 5th Avenue.
Fiscal Note
The CRA will provide funding for the administrative costs.
Recommendation
Recommended Motion: The City Commission: 1) approve the request for a Utility Easement over the Northerly Six (6.0) feet of the Southerly Thirteen and 1/3 (13.3) feet of the Easterly Seventeen (17.0) feet of Tax Parcel 13807-000-000, located at 804 Northwest 5th Avenue; and 2) authorize the Mayor to execute, and the Clerk to attest the Utility Easement, subject to approval by the City Attorney as to form and legality.
