Release of Easement at 1335 NE 6th Terrace (B)
Explanation
The City of Gainesville Public Works Departments has been working with the residents of the Hampton Heights neighborhood, along NE 6th Terrace, south of NE 16th Avenue, on the placement of street lights along 6th Terrace. At the request of a neighborhood representative, ballots were mailed to the residents along 6th Terrace. In accordance with ballot results several lights were planned along 6th Terrace. To facilitate the placement of the lights, Mr. and Mrs. Hedick granted the City of Gainesville a five foot wide easement along their south property line located at 1335 NE 6th Terrace. Subsequent to the granting of the easement, a second ballot was mailed to the residents to re-affirm their desire for the street lights. The ballot revealed that a majority of the residents were not in favor of the placement of street lights. Due to the results of the second vote, the City will not be placing street lights along 6th Terrace and therefore is recommending that the five foot wide easement granted by the Hedicks be released. There are no existing or proposed utilities located within this five foot area.
Recommendations
The City Commission: 1) approve the release of an easement to James M. and Zella Mae Hedick; and 2) authorize the Mayor and Clerk of the Commission to execute the Release of Easement, subject to approval by the City Attorney.
