AN ORDINANCE OF THE CITY OF GAINESVILLE, FLORIDA, TO VACATE, ABANDON AND CLOSE A CERTAIN PORTION OF RIGHT-OF-WAY OF SOUTHEAST 2ND STREET LYING SOUTH OF SOUTHEAST 11TH AVENUE AND NORTH OF THE ABANDONED RAILROAD ROW, AND A PORTION OF LOT 29 OF VEITCH'S ADDITION AND A PORTION OF SOUTHEAST 11TH AVENUE LYING NORTH OF THE ABANDONED RAILROAD ROW AND WEST OF SOUTHEAST 2ND STREET AND NORTH OF LOT 40 OF VEITCH'S ADDITION; RESERVING A UTILITIES EASEMENT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A REPEALING CLAUSE; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE.

COMMUNITY DEVELOPMENT STAFF REPORT
The petitioner is proposing to close two sections of roadway, Southeast 2nd Street and Southeast 11th Avenue in order to expand the business located on the adjacent property. Both road sections end at the abandoned railroad right-of-way. The City is negotiating with the railroad for use of this right-of-way as a section of the bicycle trail. The proposed street vacation will not impair access to the trail, as there are many connection points in this area.
The petitioner is responsible for all title work required to transfer the right-of-way to private property.
The Plan Board reviewed the criteria for vacating right-of-way and recommends approval of this petition.
Public notice was published in the Gainesville Sun on June 3, 2003. Letters were mailed to surrounding property owners on June 4, 2003. The Plan Board held a public hearing June 19, 2003. Planning Division staff recommended that the Plan Board approve the petition. The Plan Board recommended that the City Commission approve Petition 32SVA-03 PB. Plan Board vote 5-0.
