Explanation
While employed by GRU, Mr. Spinks was involved in an accident involving his lower back and underwent surgery. As a result of his injury and subsequent permanent work restrictions imposed by his treating physicians, Mr. Spinks is expected to potentially be accepted as permanently and totally disabled.
Recently, the City, Mr. Spinks and his attorney Lance Avera agreed to the settlement of the indemnity portion of his worker's compensation claim. The City Attorney's Office, the Risk Management Department, Special Counsel and our Worker's Compensation servicing agent all concur as to the full and final settlement of this claim. The total amount, $281,150, includes all attorney fees, past and future indemnity payments, and taxable costs.
Fiscal Note
The settlement of this case in the amount of $281,150 will be paid by Preferred Governmental Insurance Trust.
Recommendation
The City Commission authorizes Special Counsel to prepare and execute the appropriate documents for a lump-sum settlement of the indemnity portion of Manuel Melendez Spinks Worker's Compensation Claim in the amount of $281,150.
