Release of Easement to UF Foundation (NB)
Explanation
On January 16, 1967, the City passed and adopted an ordinance to close, abolish and vacate right-of-way in NW First Place between NW Fifteenth Terrace and NW Sixteenth Street, reserving an easement for utilities. The property owner that acquired a portion of the vacated right-of-way, the University of Florida Foundation, Inc., is now developing their property and will require a release of the easement to accommodate the construction of their building, known as the "105 Building".
This request for a release of the public utility easement has been reviewed and approved by staff. It was confirmed that no water, sewer, electric or gas facilities exist within the area of the proposed release.
Recommendations
The City Commission: 1) approve the release of a public utilities easement; and 2) authorize the Mayor and Clerk of the Commission to execute the Release of Easement document, substantially in the form on file, subject to approval by the City Attorney.
