Request to Issue Corrective Warranty Deed to Property Located at 1110 NW 6th Place (B)
Explanation
The City acquired Tax Parcel 13877-000-000, located at 1116 NW 6th Place, from C. W. & Dora Beasley by Warranty Deed on December 29, 1980 (OR Book 1320, Page 971). The property was acquired for low to moderate income housing. The City acquired another parcel with an existing residential structure, Tax Parcel 13878-000-000, located at 1110 NW 6th Place, from Willie Lee Jones as personal representative of the Estate of Pinkey Estell Tomlin Jones (deceased), by Personal Representative's Deed on August 26, 1981 (OR Book 1369, Page 315). On February 17, 1984, the City executed a Warranty Deed conveying Tax Parcel 13877 to Mary S. Wallace and Leroy A. Jackson Jr. (OR Book 1554, Page 807). However, a scrivener's error listed the lot number as Lot 14 (Tax Parcel 13877-000-000) instead of Lot 15 (Tax Parcel 13878-000-000), as was the intent. Mary S. Wallace and Leroy A. Jackson Jr. have occupied and maintained the residence since 1984.

The recording fees will be paid from Public Works Operating Funds.
Recommendation
The City Commission: 1) approve the request to issue a corrective deed to correct the scrivener's error that conveyed Lot 14 (Tax Parcel 13877-000-000) to Mary S. Wallace and Leroy A. Jackson, Jr., instead of conveying Lot 15 with the residential structure (Tax Parcel 13878-000-000), as was the intent; and 2) authorize the City Manager to prepare a corrective Warranty Deed, subject to approval by the City Attorney, to properly convey Lot 15, Tax Parcel 13878-000-000, located at 1110 NW 6th Place to Mary S. Wallace and Leroy A. Jackson, Jr; and 3) authorize the Mayor to execute, and the Clerk to attest, a corrective Warranty Deed to properly convey the property located at 1110 NW 6th Place to Mary S. Wallace and Leroy A. Jackson, Jr.
