An ordinance of the City of Gainesville, Florida, creating Article IX, of Chapter 2 of the City of Gainesville Code of Ordinances, establishing a living wage requirement for certain employees of contractors providing selected services to the city; providing directions to the codifier; providing a severability clause; providing a repealing clause; and providing a delayed effective date with a sunset provision.
 
recommendation
The City Commission adopt the proposed ordinance, as amended.
 
explanation
On November 25, 2002, the City Commission authorized the City Attorney to prepare and the Clerk of the Commission to advertise an ordinance establishing a living wage for certain employees of contractors providing services to the City.  Management has indicated that numerous meetings were held with representatives from business community, the living wage coalition, and several of the City's small minority businesses, to receive comments on management's proposal.
 
The attached ordinance imposes obligations on contractors performing listed services for the City.  This includes, but is not limited to, making various certifications as part of the contract award process, record keeping during the performance of the contract, and the payment of certain levels of compensation to designated employees working on the contract with the City.  The ordinance also provides for enforcement mechanisms and prohibits retaliation against those exercising their rights under the ordinance.  The ordinance becomes effective 180 days after the date of adoption and applies to new contracts for covered services solicited for, or extensions or amendments of existing contracts for covered services, entered into after that effective date.
 
As noted previously, the word "it" on page 7, line 15, of the proposed ordinance was surplusage and has been removed.
