Resolution Granting a Perpetual Easement along SR 26 (University Avenue) to FDOT (B)
Explanation
The Florida Department of Transportation (FDOT) is reconstructing SR 26 (University Avenue) and SR 26-A (SW 2nd Avenue) from SW 38th Street to North-South Drive. The FDOT is requesting that the City convey a perpetual easement for a parcel lying between SR 26 and SR 26-A and located on the south side of SR 26 for the purpose of constructing a storm water facility, sidewalks, seat walls, retaining walls, and maintaining the storm water facility.
The FDOT has provided a letter dated June 15, 2004 stating that they would pay the cost of any alteration, adjustment, or relocation, including the cost of acquiring appropriate easements in the event the City must relocate its facilities from this parcel.

There is no fiscal impact from this request.
Recommendation
The City Commission: 1) adopt the Resolution; and 2) authorize the Mayor to execute a perpetual easement to FDOT for a parcel lying between SR 26 and SR 26-A and located on the south side of SR 26 to be used for storm water facility construction and maintenance.
