Pepsi Bottling Company Release of Easement (B)
Explanation
In 1981, M.M. Parrish and Associates developed the plat of Northwest Industrial Park, Unit 3. This commercial development is located north of US 441 and east of State Road 121. The Pepsi Bottling Group is currently proposing to develop Lots 4 through 7 in Northwest Industrial Park. The proposed development plans for a new 30,000 square foot warehouse and would create an encroachment on the existing platted easements located on Lots 5 and 6. Therefore, the owner has requested the release of the 10' wide platted public utility easement on Lots 5 and 6.
This request for a release of the public utility easement has been reviewed and approved by staff. It was verified that no electric, water, sewer or gas lines exist within the easement. The City of Gainesville is releasing only its interest and other public utility entities will each have to release their interests separately. The owner has been advised of this information.
Recommendations
The City Commission: 1) approve the release of a public utilities easement; and 2) authorize the Mayor and Clerk of the Commission to execute the Release of Easement, substantially in the form on file, subject to approval by the City Attorney.
