Explanation
Walnut Creek is a residential planned development approved by the City Commission on October 9, 2000. Subdivision of this site is a requirement of the Planned Development zoning ordinance. A design plat for the development was approved on March 26, 2001. The Walnut Creek Planned Development Ordinance states: "A final plat or conditional plat shall be adopted within one year of the design plat. A one year extension from this time limit may be granted by the City Commission upon application filed by the owner/petitioner prior to the expiration of the one year period and upon good cause shown by the owner/petitioner." A letter of application was received by the Planning Division on February 25, 2002, that details a series of events subsequent to Design Plat approval that are submitted as evidence of cause for the request of the extension. Gainesville Regional Utilities has approved the construction plans, and the construction plans are currently under review by the Public Works Department.
The City Commission approved the design plat with conditions on March 26, 2001 by a vote of 4-0. Construction plans were first submitted to the City for revision on April 19, 2001. The delay in processing the final plat is due to the administrative law procedure from a challenge to the water management districts' stormwater permit application.
