The City Commission authorize the City Attorney, and/or special counsel if insurance coverage is available, to represent the City in the case styled James W. Kimbrough v. Thomas F. Barry, Jr., in his Official capacity as Secretary of the Florida Department of Transportation, and City of Gainesville, Florida.

 

...explanation

On May 1, 2000, a summons and complaint was served on the Mayor by James W. Kimbrough.  Mr. Kimbrough has sued the City and the Florida Department of Transportation alleging that the City and DOT negligently maintained a section of the Hogtown Creek, which negligence caused flood damage to his home in July, 1996.  Mr. Kimbrough seeks damages for that flooding and his costs in bringing the action.
