Partial Release of Easement (B)
Explanation
In October 1994, Riley and Margaret Blitch granted the City a blanket public utility easement on a 60 acre tract of land located in the 8800 block of Millhopper Road. The Blitches have since divided a portion of their land into several parcels and sold them to individual owners. The current owners of one of these properties located at 5314 NW 88th Street, David Petty and Tara Boonstra Petty, have requested that their parcel be released from the blanket easement. This will require the City to grant a Partial Release of the existing blanket easement.
Staff has reviewed this request for a Partial Release of Easement and recommend the granting of the same as no utility facilities are in existence on the property. The owner of the property understands that if they develop the property in the future, they would be required to provide a metes and bounds utility easement to cover any GRU maintained utility facilities.
Recommendations
The City Commission: 1) approve the partial release of a blanket public utility easement located at 5314 NW 88th Street; and 2) authorize the Mayor and Clerk of the Commission to execute the Partial Release of Easement, substantially in the form on file, subject to approval by the City Attorney as to form and legality.
