Explanation
Violet and William Pendley granted a public utilities easement to the City of Gainesville on October 27th, 1992 for the installation, operation and maintenance of overhead electric facilities to serve their residence at 4321 SW 24th Avenue. Recently the property in which this easement lies was sold and the new owner has removed the residence located on the property. Consequently, staff has received a request from the new owner to remove the electric facilities and release the subject easement.
Staff has reviewed and approved the owner's request to remove the electric utilities and release the easement covering those facilities.
Recommendations
The City Commission: 1) approve the release of a public utilities easement located at 4321 SW 24th Avenue to S. Clark Butler, as Trustee of the S. Clark Butler Revocable Trust; and 2) authorize the Mayor and Clerk of the Commission to execute the Release of Easement, substantially in the form on file, subject to approval by the City Attorney.
