Kirkwood Special Assessment Public Hearing Date (B)

Explanation

The City has accepted the Kirkwood roadways for perpetual maintenance.  The City Commission has adopted a resolution to declare and implement a special assessment.   Florida Statute 170 requires that the City shall by resolution set a time and place of a public hearing regarding the proposed improvements.  Florida Statute further requires that written notices be sent to all property owners to be assessed outlining the logistic details of the public hearing.  A Notice of Hearing is also required to be published in a newspaper of general circulation. 

Fiscal Note

Funds are available in the annual operating budget of the Public Works Department for postage and publishing fees. 

Recommendation

The City Commission: 1) approve the resolution to set a date, time and place for a public hearing; and 2) authorize the City Manager or his designee to advertise the time and place of the public meeting in a newspaper of general circulation; and 3) authorize the City Manager or his designee to send written notices informing of the public meeting time and place to all property owners who will be affected by the assessment.
