Explanation
While employed as a Meter Technician, Mr. Holloway suffered a neck and shoulder injury which has required ongoing medical treatment. As a result of his injury, and subsequent permanent work restrictions imposed by his treating physicians, Mr. Holloway is no longer able to perform the essential functions of his job as a Meter Technician.
Recently, the City's Excess Carrier and Mr. Holloway attempted to mediate a settlement of his worker's compensation claim. Mr. Holloway and his attorney, Mr. Tony Salzman, have agreed to the proposed settlement. The City Attorney's Office, the Risk Management Department, Special Counsel, Worker's Compensation Servicing Agent and the City's Excess Carrier all concur as to the full and final settlement of this claim. The total amount of $195,000 includes all attorney fees, future medical costs, past and future indemnity payments, taxable costs and all set aside amounts.
Fiscal Note
The settlement of this case in the amount of $195,000 will be initially paid out of the General Insurance Fund and will be 100% reimbursed by the City's Excess Carrier.
Recommendation
The City Commission authorize Special Counsel to prepare and execute the appropriate documents for a lump-sum settlement of the Worker's Compensation claim of Raymond C. Holloway, in the amount of $195,000.
