Explanation
While employed by GRU Energy Delivery, Mr. Cunningham received bilateral injuries to his hands and wrists. This led to ongoing medical treatment including surgery. As a result of his injuries, the present potential exposure to the City in future indemnity payments and medical treatment is in excess of $75,000.
Recently, the City and Mr. Cunningham attempted to mediate a settlement of his worker's compensation claim. Mr. Cunningham and his attorney, Carl Carrillo, have agreed to the proposed settlement. The City Attorney's Office, the Risk Management Department, GRU, Special Counsel and our Worker's Compensation servicing agent all concur as to the full and final settlement of this claim. The total amount, $23,000, includes all attorney fees, future medical costs, past and future indemnity payments, and taxable costs.
Fiscal Note
The settlement of this case in the amount of $23,000 will be paid out of the Electric Utility Operating Fund.
Recommendation
The City Commission authorize Special Counsel to prepare and execute the appropriate documents for a lump-sum settlement of the Worker's Compensation Claim of Willie K. Cunningham in the amount of $23,000.
