Title Release of Easement to Aspen Ridge of Gainesville, Ltd. (NB) Explanation Mental Health Services, Inc. of North Central Florida granted a thirty-foot public utilities easement for a sanitary sewer line on January 4th, 1988 and a ten-foot by ten-foot easement for an electric transformer on May 2nd, 1988 on their property located at 3825 SW 34th Street. Since that time Aspen Ridge of Gainesville, Ltd. purchased the subject property and plans to develop Aspen Ridge Apartments. To facilitate the development and prevent possible building encroachments, the owners have requested that a portion of the thirty-foot easement be released and the entire ten-foot by ten-foot easement be released in exchange for a blanket public utilities easement covering the entire site. Staff has reviewed and approved the owner's request to release a portion of the thirty-foot wide easement and the entire ten-foot easement with the condition that the remainder of the thirty-foot easement be retained by the City to protect the existing sewer facilities located within that easement. The owner has been notified of this and is in agreement with staff. Staff has also received a fully executed blanket easement public utilities easement covering the entire site in accordance with this agreement. Recommendations The City Commission: 1) approve the release of one entire public utilities easement and the partial release of another public utilities easement, both located at 3825 SW 34th Street to Aspen Ridge of Gainesville, Ltd.; and 2) authorize the Mayor and Clerk of the Commission to execute a Release of Easement document, subject to approval by the City Attorney.
