Explanation
On November 17th, 1994, Thornehill, Inc., granted the City of a Gainesville a ten foot by twenty foot temporary easement for the placement of a gas tank and related appurtenances on Lot 30 in Thornehill, Phase II subdivision. Under the terms of the easement, the City's easement rights would terminate once natural gas facilities were permanently installed in the area and the gas tank removed, such time not to exceed December 31, 2004.
GRU staff has confirmed that the gas tank located on Lot 30 has been removed and that permanent natural gas facilities are now in place to serve the Thornehill subdivision. A letter confirming the removal of the gas tank was prepared by GRU staff on July 16th, 1998 to facilitate the closing of the property. However, the new owners have requested that a formal release of easement be filed in the public records to clear this cloud on their title.
Recommendations
The City Commission: 1) approve the release of a temporary easement located on Lot 30 of Thornehill, Phase II subdivision located at 6614 NW 50th Lane to Adil Kabeer; and 2) authorize the Mayor and Clerk of the Commission to execute a Release of Easement instrument, subject to approval by the City Attorney.
