Modifications to Civil Citation Ordinance (B)

Explanation

The City of Gainesville Fire Rescue Department has utilized the Civil Citation process with good results.  Based upon the change in prevailing fire codes and the need to clarify language pertaining to warning notice, adjustment must be made in Chapter 2 of the City of Gainesville Code of Ordinances. The changes necessitated are as follows:

The codes identified for issuance of citations were based upon the Standard Fire Prevention Code and the NFPA 101 Life Safety Code.  On January 1, 2002 the State of Florida adopted the Florida Fire Prevention Code and mandated its use in every political subdivision of the state.  The Florida Fire Prevention Code includes National Fire Protection Association Codes 1 and 101, the Florida Administrative Code Chapter 4A, Florida Statute Chapter 633, and Chapter 5 of the State Requirements for Educational Facilities.  An amendment must be made in Chapter 2 of the City of Gainesville Code of Ordinances to reflect this change in enforceable codes.

Recommendation

The City Commission authorize the City Attorney to draft and the Clerk of the Commission to advertise an ordinance amending the civil citation ordinance.
