Release of Easement at 303 NW 17th Street (B)
Explanation
July 15, 1963 a nine foot wide easement was granted to the City of Gainesville for the construction, operation and maintenance of an electric line at 303 NW 17th Street to serve an apartment building. Recently, the City approved plans for the construction of an additional apartment building at the site. In anticipation of the new construction and in order to facilitate the additional utilities needed to serve the development, a blanket easement was granted to the City in 2001 over the entire site.
The new building will be constructed over the existing nine foot wide easement. In order to clear the cloud on the title which will be created with the construction of the new building, the owner has requested that the nine foot easement be released.
Staff has reviewed this request, and has no objection to the release of the easement. All existing and proposed utilities owned by the City are covered under the blanket easement granted in 2001. Further, staff has coordinated the relocation of the existing electric facilities located within the nine foot easement to accommodate the new development.
Recommendations
The City Commission: 1) approve the release of a public utilities easement at 303 NW 17th Street; and 2) authorize the Mayor and Clerk of the Commission to execute the Release of Easement document, subject to approval by the City Attorney as to form and legality.
