Settlement of Worker’s Compensation Claim - Shawn M. Devito (NB)
Explanation
While employed as a Police Officer, Mrs. Devito suffered multiple injuries covered by worker’s compensation. As a result of her injuries and subsequent permanent work restrictions imposed by her treating physicians, Mrs. Devito filed and is receiving in line of duty disability retirement.
Recently, the City and Mrs. Devito attempted to mediate a settlement of her worker’s compensation claim. The City and Mrs. Devito were able to settle all future medical and indemnity benefits due Mrs. Devito. Mrs. Devito and her attorney, Tonya Oliver, have agreed to the proposed settlement. The City Attorney’s Office, the Risk Management Department, Special Counsel and our Worker’s Compensation servicing agent all concur as to the full and final settlement of this claim. The total amount, $85,000, includes all attorney fees, future indemnity and medical payments, and taxable costs related to the indemnity payments.
Fiscal Note
The settlement of this case in the amount of $85,000 will be paid out of the General Insurance Fund.
Recommendation
The City Commission authorize the Special Counsel to prepare and execute the appropriate documents for a lump-sum settlement of the Worker’s Compensation indemnity claim of Shawn Devito, in the amount of $85,000.
