On November 9, 2004, the City of Gainesville was served with a summons and complaint. The complaint alleges that on or about July 11, 2000, Mr. Drake was riding his bicycle on a sidewalk under construction on N.W. 16th Avenue causing him to ride his bike around onto the grass abutting the sidewalk. It is alleged that the ground gave way and caved in causing Mr. Drake to be thrown over the handlebars of his bike. Plantiff seeks damages.
