Settlement of Worker's Compensation Claim - John Mason (NB)
Explanation
While employed as a Fire Lieutenant, John Mason suffered multiple compensable injuries: 1) hypertension; 2) a knee injury that required surgery and may require a full knee replacement; 3) lungs; 4) high blood pressure; and 5) hearing loss. This injury has required ongoing medical treatment by multiple medical providers. As a result of his injuries, Mr. Mason is no longer able to perform the essential functions of his job as a Fire Fighter/Driver Operator.
Recently, the City and Mr. Mason attempted to mediate a settlement of his worker's compensation claim. Mr. Mason and his attorney, Mr. Bichler, have agreed to the proposed settlement. The City Attorney's Office, the Risk Management Department, the Gainesville Fire Rescue, Special Counsel and the City's Worker's Compensation servicing agent all concur as to the full and final settlement of this claim. The total amount of $111,500 includes all attorney fees, future medical costs, past and future indemnity payments, and taxable costs.
Fiscal Note
The settlement of this case in the amount of $111,500 will be paid out of the General Insurance Fund.
Recommendation
The City Commission authorize Special Counsel to prepare and execute the appropriate documents for a lump-sum settlement of the Worker's Compensation claim of John Mason in the amount of $111,500.
